They allege that the device's noise abatement foam degrades to leach toxic, potentially carcinogenic particles, chemicals, and gasses into the device airway to be inhaled continually throughout the night while it is in use. "An Arizona woman has filed a product liability lawsuit that claims her recalled Philips CPAP machine caused cancer to develop, after years of exposure to toxic particles released by the device's sound abatement foam. The complaint (PDF) was filed by Shelley Favours in the U.S. District Court for the District of Arizona last week, indicating that Koninklijke Philips and its North American subsidiaries sold a dangerous product for individuals with sleep apnea," wrote Aboutlawsuits.com. The lawsuit alleges that the woman used her machine every night for several years and is currently undergoing breast cancer treatment. Her lawsuit accuses Phillips of knowing about the sound abatement foam issue for years and doing nothing to warn consumers. Phillips ignored reports of dissatisfied customers and continued to market the product for years as if nothing was wrong, the plaintiff alleges. The plaintiff also points out that she started using her Phillips sleep device in 2017 but was not warned of the problems until July 2021 when the machine was recalled, a claim echoed by other plaintiffs. This was the first accusation of the device causing breast cancer.

Royal Phillips, the maker of the sleep apnea devices, and SoClean, the maker of an Ozone cleaning solution may both be forced to defend themselves. There is a growing consensus that the SoClean Ozone cleaning solution may have contributed to the toxicity that enters the device through its airways. SoClean's sales have plummeted since the sleep apnea device's recall, which may be an indication that many people were using the cleaning solution. SoClean Ozone cleaning solution may have worsened an already defective CPAP machine. People at Royal accuse the SoClean cleaning solution to be the sole cause of the device breaking down. SoClean is suing Phillips for $200 million that they say was lost due to a decrease in sales over the product's bad publicity. More than 15 million consumers may have been using the sleep apnea machine when it was recalled.

Consumers that have been affected by the Phillips CPAB recall will have a difficult choice whether or not to replace their machine. Phillips has said they would repair customers' machines but have been dragging their feet implementing the solution. Phillips's actions may be the evidence plaintiffs need as communications that were recently uncovered show that Philips was aware of customer foam noise abatement issues but did nothing. An investigative report by NBC Chicago writes, "After the company had received complaints of foam degradation in its products, in 2018, inspectors found a conversation over email with Philips' staff acknowledging the company's own internal tests had confirmed the foam could fall apart when exposed to high humidity or heat."
