New Lawsuits Allege CPAP User Developed Pancreatic Cancer From Using the DreamStation CPAP device

Monday, November 1, 2021 - Phillips CPAP lawsuits continue against Koninklijke Philips and its North American subsidiaries claiming that the Phillips Dreamstation caused users to develop cancer. The complaints focus on the Phillips Dreamstation CPAP machine recalled over the summer, allegedly due to the machine's sound abatement foam insulation degrading into toxic particles, gasses, and chemicals sent into the user's nose and lungs. If the science proves correct, millions of Americans may have life-threatening lung disease and possibly lung cancer. A recent lawsuit claims that using the Phillips DreamStation machine regularly over more than a year caused or contributed to the development of the plaintiff's cancer. AL describes the case as indicative of Phillips failing to warn customers of what they knew or had an obligation to know about the design defect for several years after customers were diagnosed with cancer. " In September 2015, he (the plaintiff) was diagnosed with pancreatic cancer, indicating that he was unaware of the potential link between his cancer and CPAP machine until the recall was announced in June 2021.

Phillips denies that the foam degradation was due to a design defect, and redirects the blame on SoClean Inc. Ozone cleaning solution. Phillips CEO has told the press the company not only did not approve the cleaning solution but also told customers not to use it. The CEO went on to say that if customers chose to use the Ozone cleaning solution it would violate the machine's warranty. SoClean has denied the accusations and has filed a $200 million lawsuit against Phillips for defamation resulting in the loss of hundreds of millions of dollars in sales. Not only has SoClean filed suit for defamation, but the US Attorney General has also warned Phillips to step up and make good on their promise to repair or replace the three million defective sleep apnea devices. The AG has instructed the Food and Drug Administration to increase their monitoring of the recall situation.

The Phillips CPAP recall has started a chain reaction of problems that could occur in the wake of millions of users being unable to use their machine and get an acceptable night's rest. CPAP users are continuing to use the device because they are unaware of the machines problems and the recall, or they don't care because sleepling at night trumps the allegations of the machine's defects. Millions of Phillips sleep apnea machines may also lie unused, collecting dust in patient's closets because the owner no longer needed to use it.
