The FDA Thinks The Phillips CPAP Machines May Lead To Developing Deadly Forms of Cancer

The FDA's Type 1 recall is seldom issued and reserved for only the most critical product negligence situations

Friday, January 28, 2022 - People who have used the Phillips CPAP sleep apnea machine regularly for several years have accused the manufacturer of failing to warn them that a malfunction in the breathing apparatus may cause them to inhale toxins and develop several types of deadly diseases. Lawsuits accuse Phillips CPAP machines of causing lung cancer and other respiratory illnesses. Plaintiffs also accuse it of causing mouth and brain cancer. Customers have complained that the sound abatement foam could degrade and leach toxic black particles, toxic gasses, and chemicals into its clear airway tube leading to breathing problems. Experts think high temperatures and the unapproved SoClean Ozone cleaning solution may have caused the foam to degrade. Hundreds of Phillips CPAP lawsuits accuse the device of causing Phillips CPAP cancer.

Sleep apnea machines are a highly-effective way to treat obstructive sleep disorder (OSD) by forcing oxygen into the mouth and nose and keeping the airway open. OSD patients seldom sleep well, are awakened many times per night by their snoring, have uncomfortable dry mouth and sore throat, painful sinuses, headaches, and other debilitating symptoms. One person suing Philips for causing brain cancer adds neck pain, vision problems, nausea, chronic cough, shortness of breath, and difficulty swallowing to the list of issues caused by the Phillips device leading to his cancer diagnosis, according to an article in AboutLawsuits.com.

The Phillips brain cancer lawsuit alleges, as do other Phillip CPAP lawsuits, that the company was aware for years about the breathing apparatus contamination but did nothing to rectify the problem until months or years later when a suitably profitable substitute could be made available. The company should have notified customers to stop using all unapproved cleaning solutions and provide a free substitute cleaning solution. The company should have advised customers to clean their machines after every use until the problem could be rectified. Instead, Royal Phillips ignored customer complaints and continued to sell the device to unsuspecting customers, pocketing millions of dollars in profits every year. AL writes that in addition to ignoring customer complaints, Phillips stands charged with "negligence, design defect, manufacturing defect, failure to warn, breach of warranty, fraudulent misrepresentation, fraud by omission and negligent misrepresentation," according to the brain cancer lawsuit.

Lung cancer, throat and mouth cancer, and now brain cancer have been added to stomach, thyroids, breasts, and kidney cancer, all deadly diseases, that Phillips CPAP machines are accused of causing. The US Food and Drug Administration (FDA) issued a Type 1 recall for the machines because the agency viewed the situation as so dangerous as to pose a threat of death if ignored. "Products subject to a Class I recall, according to the FDA, pose a "reasonable probability that the use of or exposure to a violative product will cause serious adverse health consequences or death." According to LegalExaminer. Royal Phillips, a Dutch company, stands accused of failing to take the FDA's warning seriously and putting millions of American lives at risk unnecessarily.
