Phillips Respironics And SoClean Inc. May Have To Share Responsibility For CPAP User Cancer

Both companies accuse the other of being responsible for the chemical degradation of the CPAP device sound abatement foam

Monday, February 7, 2022 - On October 12, 2021, SoClean Inc., the maker of SoClean Ozone Cleaning Solution, filed a $200 million lawsuit alleging PhillipsRespironics misled the public with statements blaming the cleaning solution for causing their customer's breathing difficulties. SoClean Inc. alleges in their suit, as do hundreds who have filed Phillips CPAP cancer lawsuits, that it was Phillips' poor choice of the Pe-Pure brand of polyester-based polyurethane foam used to dampen the noise the machine makes for causing illness. The lawsuits alleges that it was the inherently faulty design of the CPAP sleep apnea machine that caused toxic particles, gasses and chemicals to leach out through the device's airway and into the face mask. SoClean CEO Robert Wilkins said in a statement. "By this lawsuit, SoClean intends to defend itself against Philips' dishonest attacks, restore its hard-earned reputation, and correct the record for a consuming public that has been intentionally misled by Philips," according to AboutLawsuits.com (AL).

Hundreds of Phillips CPAP cancer lawsuits allege that using the device regularly caused them to develop various types of cancer, including cancer of the mouth, throat, and lungs. The basis for the lawsuits is the noise abatement foam leaches toxic, potentially carcinogenic particles, chemicals, and gasses directly into the airway to be breathed by the users with every breath without their awareness until it is too late and the symptoms of lung illnesses like asthma or cancer become apparent. Phillips claims that it was the unapproved and controversial SoClean Ozone cleaning solution that damaged the machine and that the device works perfectly when used as directed. Phillips urges users to clean their device regularly and also warned that using unapproved Ozone cleaning products was prohibited, voided the warranty, and could cause health issues.

In June 2021, Phillips recalled all of their CPAP, BiPAP, and ventilator devices, promising to repair or replace them without admitting they were responsible for the defects. The US Food and Drug Administration also warns CPAP users not to use Ozone cleaning solutions and to abide by the device manufacturers users manual. "Be aware that the FDA has not evaluated the safety and effectiveness of ozone gas or UV light products claiming to clean, sanitize or disinfect CPAP machines and accessories in the home or healthcare setting. Understand the potential risks from exposure to excessive amounts of ozone gas or UV light as described below include irritation to breathing passages (that is nose, throat, and lungs), particularly for those who have respiratory sensitivity such as asthma or allergies," the FDA warns. CPAP users should read the latest FDA Ozone cleaning solution warnings on the FDA's website. While most lawsuits accuse Phillips Respironics of negligence, there are also more than 11 class-action suits against SoClean Inc. alleging the cleaning solution and not the device is responsible for their lung disease. Both Phillips CPAP and SoClean lawsuits have been organized in multidistrict litigation under Senior U.S. District Judge Joy Flowers Conti in the Western District of Pennsylvania.
