Phillips NV Claims That A Third-Party Cleaning Solution Is The Cause Of Their Sound Abatement Foam Degrading

Phillips faces a $200 million lawsuit after blaming their products malfunction on the manufacturers of a third-party cleaning solution

Thursday, October 14, 2021 - Phillips NV may be digging their defective sleep apnea device liability hole much deeper by blaming a third party for causing their sleep apnea machines to malfunction. It has been reported that SoClean Inc., the company that manufactures cleaning liquid used to clean recalled Phillips sleep apnea devices, has filed a lawsuit to combat the accusation being made against them by the embattled company. Phillips is accused of falsely blaming the recall of 3 million of their sleep apnea machines on the machine's cleaning products rather than on the sleep apnea device's inherent design flaws. According to Reuters, "Dutch medical equipment company Koninklijke Philips NV has been hit with a $200 million lawsuit accusing them of deceiving the public and the healthcare industry by falsely linking the problems with its recently recalled sleep-apnea machines to ozone-based cleaning methods". Phillips CPAP sleep apnea machines have been recalled because the insulative foam used to quiet the machine's motor degrades and causes toxic, carcinogenic particles, chemicals, and gasses directly into the device's airway where it is inhaled into the lungs continuously throughout the night. SoClean alleges that their cleaning solution is being falsely blamed by Phillips for causing the soundproofing foam to degrade. The CEO of Phillips has stated before the company directors that the SoClean Ozone products were not approved and should not be used on any of their products and is the cause of the sound abatement foam degrading. An executive at SoClean says that the Phillips claims are baseless and an attempt to deflect blame from their defective device. They also said that SoClean has suffered hundreds of millions of dollars in lost sales and damage to their reputation as a result of the slander.

CPAP cancer lawsuits against Phillip NV accuse them of bringing a faulty medical device to market. Plaintiffs that have filed suit claim that they have developed many different types of lung disorders from using the device, like "chronic bronchitis, pneumonia, and other respiratory side effects, after breathing chemicals from deteriorating sound abatement foam, " according to About Lawsuits.com. The website quotes the plaintiff as saying, "After using the sleep apnea machine nightly between May 2017 and June 2021, Hogan (the plaintiff) indicates she began to experience chronic bronchitis, COPD, sarcoidosis, pulmonary hypertension, severe headaches and was diagnosed with pneumonia at least three times." The lawsuit blames the degradation of the PE-PUR sound abatement foam and inhaling carcinogens as the cause of her condition. The woman alleges she was not warned, nor suspected that her medical device was defective. It was not until she read reports like this did she become suspicious.

The Insurance Journal tells readers to expect "potentially massive litigation over the recalled Philips sleep apnea machines." More than 100 lawsuits have been filed and are being coordinated through multidistrict litigation in federal court in Pittsburg, Pennsylvania, the home of Phillips's main CPAP manufacturing facilities. The honorable U.S. District Judge Joy Conti is presiding.
