Problems Mount For Royal Phillips From Multiple Sources Over CPAP Machine Malfunctions

Customers, businesses, and the US government are pressuring Phillips to take responsibility and repair or replace CPAP machines immediately

Saturday, October 23, 2021 - Phillips CPAP sleep apnea machines are intended to be used every night, seven days per week, three hundred and sixty days per year. There is never a night where a person that suffers from sleep apnea can take the night off from using the device and expects to have a long, restful sleep as the machine provides. Like any mechanical device, however, maintenance is needed periodically. More than oiling or manually repairing the device, users are urged to keep the airways leading from the machine to the user's nose clean and particle-free. Phillips CEO stresses that the company does not endorse any particular cleaning solution and that the SoClean ozone cleaning solution product is to blame for the machine breaking down. Users are suing Phillips because they have become ill after using the machine. The reason for the illnesses, which allegedly include developing or exacerbating the symptoms of asthma, lung infection, emphysema, and Phillips CPAP cancer, is that the machine exuded toxic, carcinogenic particles, gasses, and chemicals from the degrading noise abatement foam. Phillips is being sued for $200 million by SoClean for defamation and falsely accusing their products of causing the Phillips CPAP machines to malfunction and that the bad publicity has cost SoClean hundreds of millions of dollars of sales. MDDIonline.com reports, "SoClean alleges in the suit that Philips and Frans van Houten, the company's CEO and board chairman, made false and misleading statements regarding ozone cleaners and that these statements have had a negative impact on SoClean's business. The complaint states that Philips and van Houten suggested to consumers, distributors, healthcare professionals, and the general public that SoClean and its ozone cleaners were somehow responsible for the Phillips CPAP recall." The decline in sales, however, seems more likely due to SoClean customers no longer needing the solution as about 3 million Phillips CPAP and ventilator devices have been recalled. Phillips CPAP users have no need for a cleaning solution if they are not using the device. Users have been advised to discontinue using the Phillips CPAP devices unless they were using them for life-substance as in being on a ventilator to treat Covid-19. In addition to the more than 100 lawsuits filed against them, the accusations and lawsuit from SoClean, Phillips is accused by US Attorney General William Tong of failing to fulfill their promise to repair or replace every model of CPAP device subject to the recall. The AG has instructed the Food and Drug Administration to step up its effort to get Phillips to send replacement parts and instructions on repair to their customers. The Phillips recall is complicated by the fact that millions of CPAP users have discontinued using their devices and are unaware of the recall. Achieving a high percentage of replacement may be impossible if more than half of the machines that have been sold are collecting dust in customers' attics. Class action lawsuits may seek that Phillips pay for ongoing medical testing for patients that can prove they have used the machine regularly for more than a year and done so on the advice of their doctor who has diagnosed their sleep apnea.
