Phillips CPAP Lawsuits Allege The Machine Causes Varying Degrees of Respiratory Illnesses

Some former Phillips DreamStation users have developed life-threatening respiratory conditions as serious as lung cancer

Tuesday, April 5, 2022 - Reports are being made, following the Phillips CPAP recall, indicating that the malfunctions of the Phillips DreamStation sleep apnea machine, and others made by Phillips Respironics, have caused varying degrees of respiratory distress. Some people have developed lung conditions as serious as lung cancer and have filed Phillips CPAP cancer lawsuits against the device's manufacturer. Other illnesses have come to light in the form of lawsuits that have been filed in state courts around the country.

A man from Alabama is suing Phillips Respironics for their sleep apnea machine allegedly causing his bladder cancer. According to the New York Legal Examiner (NYLE), the man first realized he had a serious condition when he noticed blood in his urine, which after medical diagnosis required the organ to be surgically removed. The illness caused the man to suffer extreme pain from cancer, surgery, and follow-up care. He also lost his job and was forced to incur medical expenses, both of which he is looking to have reimbursed by Phillips in his lawsuit. The Alabama man alleges, like most other Philips CPAP cancer lawsuits, that the machine's sound cancellation foam physically degraded over time, releasing carcinogenic particles, chemicals, and gasses into the machine's airway causing him to inhale the toxins over and over throughout the night. The harmful chemicals that the machine releases are on the list of carcinogens that the Centers for Disease Control (CDC) recognizes to cause kidney disease according to NYLE. In another recently-filed lawsuit, four Pennsylvania former Phillips CPAP machine users have filed suit alleging that the machine caused their health problems. NYLE writes, "According to the complaint, all four plaintiffs used recalled Philips breathing machines, and all suffered from potentially related illnesses, including kidney disease, respiratory disease, sinus irritation and headaches, and dry mouth syndrome." A third lawsuit alleges that using the Phillips DreamStation caused the plaintiff to suffer long-term, severe, respiratory failure. Like the two lawsuits before him, the Arkansas man is alleged to have used the machine every day to treat his sleep apnea condition and repeatedly inhaled toxins leading to his illness. The man's acute respiratory failure was diagnosed as hypoxia. Wikipedia describes hypoxia as "a condition in which the body or a region of the body is deprived of adequate oxygen supply at the tissue level." Hypoxia is an extremely dangerous, life-threatening condition as “without oxygen, your brain, liver, and other organs can be damaged just minutes after symptoms start," according to WebMD. People with chronic hypoxia are required to wear an oxygen mask and use an oxygen tank to force more air into the lungs.

These lawsuits and others have been consolidated into multidistrict litigation to be presided over by U.S. District Judge Joy Flowers Conti in the Western District of Pennsylvania. The MDL is intended to streamline administrative court proceedings and make the science underlying the sleep apnea device malfunctioning understandable. In July 2021, the Food and Drug Administration (FDA) issued a Class I recall, a designation reserved for drugs and medical devices that themselves can cause serious bodily harm and death.
